Terms and Conditions for EV SOS Network
Welcome to EV SOS Network, a platform that connects electric vehicle (EV) owners in need of emergency charging with hosts offering their home chargers for public use. By using our services, either as a driver or a host, you agree to the following terms and conditions. Please read them carefully before using the platform.
1. Definitions
- “Platform” refers to the EV SOS Network website and any associated services provided by us.
- “Driver” refers to any person using the platform to find and book an EV charger.
- “Host” refers to any individual offering their EV charger for use by drivers through the platform.
- “Booking” refers to the reservation of a host’s charger by a driver.
- “Service” refers to the connection between drivers and hosts facilitated by the platform, including payments and bookings.
2. Use of the Platform
- The platform is provided to facilitate connections between EV drivers and hosts. It does not provide any direct charging services. All charging is carried out at the host’s location.
- By using the platform, you agree to act in accordance with local laws and regulations, as well as these terms and conditions.
3. Eligibility
- To use the platform as a host or driver, you must be at least 18 years of age and have the legal capacity to enter into contracts.
- EV drivers must own or operate an electric vehicle and must ensure that their vehicle is compatible with the host’s charger.
- Hosts must ensure their charger is fully functional, properly maintained, and safe to use by third parties.
4. Bookings and Payments
- Booking Process: Drivers can search for and book a host’s charger via the platform. A booking is confirmed once payment is made and the host accepts the booking. EV SOS NETWORK will take a 10% none refundable commission will be automaticly deducted from all bookings.
- Pricing: Hosts set their own prices for the use of their chargers. Prices must be clearly displayed to drivers before they make a booking.
- Payment Processing: All payments are processed through the platform’s secure payment gateway. Drivers must pay for the booking upfront, and hosts will receive payment once the charging session is completed.
- Cancellations:
- Drivers may cancel bookings within 24 hours before the scheduled charging time for a full refund. Cancellations within 24 hours may result in a partial or no refund, depending on the host’s cancellation policy.
- Hosts may cancel bookings up to 24 hours before the scheduled time. If a host cancels within 24 hours of a booking, they may be penalized and removed from the platform for repeated offenses.
5. Responsibilities of Drivers
- Drivers are responsible for arriving at the host’s location at the agreed-upon time.
- Drivers must use the host’s charger in a safe and responsible manner, following any instructions provided by the host.
- Drivers are liable for any damage caused to the host’s property or charger during the charging session.
6. Responsibilities of Hosts
- Hosts must ensure that their charger is fully operational, safe, and accessible during the scheduled booking time.
- Hosts should communicate clearly with drivers regarding the use of their charger and any relevant access instructions.
- Hosts are responsible for keeping their charger and surrounding area in good condition. Any issues with the charger must be reported to the platform and drivers in a timely manner.
- Hosts must not charge drivers outside of the platform for bookings made through EV SOS Network.
7. Liability
- EV SOS Network acts as an intermediary between drivers and hosts and does not take responsibility for the condition, safety, or availability of the chargers listed on the platform.
- We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform, including issues related to bookings, charger malfunctions, or property damage.
- Both drivers and hosts agree to indemnify EV SOS Network against any claims or disputes arising from the use of the platform.
8. Dispute Resolution
- In the event of a dispute between drivers and hosts, both parties should first attempt to resolve the issue directly. If an agreement cannot be reached, either party may contact EV SOS Network for mediation.
- EV SOS Network reserves the right to suspend or terminate any account involved in repeated disputes or violations of these terms.
9. Termination and Suspension
- EV SOS Network reserves the right to suspend or terminate access to the platform at its discretion, including in cases of non-compliance with these terms and conditions or any misuse of the platform.
- Hosts and drivers may also deactivate their accounts at any time by contacting customer support.
10. Data Privacy
- Your personal data will be collected, processed, and stored in accordance with our Privacy Policy. By using the platform, you consent to the collection and use of your data as outlined in the policy.
11. Modifications
- EV SOS Network may modify these terms and conditions at any time. Changes will be posted on the platform, and continued use of the platform after changes have been made will constitute acceptance of the updated terms.
12. Governing Law
- These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom. Any legal disputes will be subject to the exclusive jurisdiction of the courts in the UK.
